			<description>An effective alternative to Court


Parties are increasingly turning to Mediation (mediation.html) and Arbitration (arbitration.html), two forms of Alternative Dispute Resolution (dispute-resolution.html), to resolve their disputes. Both are as binding as a Court judgment but, unlike Court proceedings, they are confidential and flexible to meet the needs of the circumstances of an indivudual case.  Construction and  Consumer disputes are commonly resolved by Adjudication. 


Mediation is encouraged by the Courts and the Court Service is involved with the National Mediation Helpline.  The Mediation Questions and Horror Stories pages in the Mediation section of this site show why Mediation in particular is an effective and cost-effective alternative to Court proceedings.   


MediationandArbitration.co.uk is a grouping of capable, experienced professional Practitioners who have chosen to specialise in Dispute Resolution - Mediation, Arbitration and Adjudication - and bring to their Practices their knowledge, skill and professionalism built up over many years of professional practice. They also act as Expert Witnesses. 


It is led by David Ellwood.  Admitted as a Solicitor in 1972, he brings to his Dispute Resolution Practice many years experience of legal practice.  He has a Diploma in Arbitration and is a Fellow in Arbitration, and an Accredited Mediator, of the Chartered Institute of Arbitrators. (news/latest/ciarb-profile.html)  Both qualifications are the Chartered Institute's highest academic qualification. 


With a strong background in both contentious and non-contentious legal work, he ensures that he has a full grasp of the papers and approaches parties and their disputes with courtesy and understanding and regards careful preparation as a necessary prerequisite to a good result.

As a Mediator, he uses 
his expertise, tenacity and practical reasoning to help parties to a compromise acceptable to them both.  He acts as Arbitrator in cases in which parties cannot agree a settlement of their dispute.


For areas of work for which greater specialist experience than his is required, he calls on a small group of carefully chosen Practitioners, well-qualified and vastly experienced in their specialist areas and in Dispute Resolution.  Their approach mirrors his own.



They act in accordance with the Codes of Conduct of their  professional bodies, including the Chartered Institute of Arbitrators, the Association of Midlands Mediators and the Law Society, which incorporate the European Code of Conduct for Mediators.
